Permanent Foundations

As I am a new RE agent in Kansas I’'m still learning so any input would be greatly appreciated. I am working with a buyer, we submitted and offer that was accepted. The sellers agent told us the foundation was permanent as it needed to be to use a fha loan. Come to find out after whole home inspection and termite inspection the home in fact was not on a permanent foundation. As the buyers agent can I request that the other agent or sellers cover my buyers expenses as they gave us incorrect information that led us to order inspections and have them done.

it probably depends on how the other agent worded the statement.

Was it “In my opinion, there is a permanent foundation”
or “I believe there is …”?

Followed by a recommendation to hire a licensed expert (engineer)?

That’s just an opinion and not worth anything.

Unless this other agent gave you some firm statement about the foundation, you are out of your money. That’s my opinion and I recommend that you consult your broker and/ or his attorney.
