Victory of property rights over eminent domain

The Georgia Supreme Court has given property owners a victory over cities seeking to take over their properties through eminent domain.

The issue was the property was going to be razed for a public park. The state law says you can use eminent domain only for public necessities like utility right of ways or building roads.

Gosh, can I replace “eminent domain” with rent control???:slight_smile:

That’s huge. In the past, eminent domain included redevelopment of land. They just had to think the new purpose was in the best interest of the public.
