Rule of law is good. Legal activism and judicial activism will kill this country.

Many lawsuits are without merit. It just exploits the expensive legal procedures and unpredictable jury system to terrorize another party to extract money. Many people and insurance company just settles for no reason to avoid the huge trial cost. For poor people, they are judgement proof. They don’t care if they lose since they have no ability to pay anyway. Free lawyers will kill this country.

Many large corporations act the other way. Rich companies can sue the smaller company and the legal cost and risk and resource drain would force the small companies out of business or settle.

On a somewhat related topic I went hiking with a friend today at Almaden Quicksilver. We discussed all sorts of things ranging from Arizona, where I’m moving full time in October, to the hurdles of widespread adoption of renewable energy to philosophical arguments around whether scarcity of resources (energy, water, etc.) is really a question of scarcity or a question of availability, solvable by technical advancement. We also talked about jaguar sightings in Arizona and the rest of the southwest and about alligator lizards in Arizona. This is an e-mail I just got from him -

Right after hike opening youtube (trying to look for Arizona alligator lizards).
Before I get to it, youtube suggests the following 2 videos: (1) “Jaguars are returning to Southern Arizona”, (2) interview with a german philosopher / intellectual (who I didn’t know until know but just clicked on it and among the first 10 sentences: “Getting more fuel efficient is not enough if we triple the number of cars, so we need stop talking only about efficiency…”.
I never looked for any of that before, it’s as if we’ve been listened to and got targeted video placement. It’s true that all cell phones these days have microphones that can’t be turned off (even if phone turned off (but not if powered down))… I honestly suspect this is placed based on our conversation. Brave new world…

Privacy is dead years ago. But if you stop using electronic communication media, you can still have your privacy to some degree.

We have to deregulate, have less regulations. Too much regulation and loss of privacy can make everyone eligible to go to jail. When people talk for 300 hours, there’s a 95% chance to commit discrimination or other crimes people only commit when they think their conversation is private. Without privacy, we can put 95% of the people into jail. Another 5% will be fired due to inappropriate or insensitive talking.

That is exactly why you need regulation. Here is one: ensure conversation between two people must be end to end encrypted.

If you leave it wild west, you will see peoples facebook posts distributed like hot cakes, their search intentions are used as an evidence and so on. They would not even need a warrant when they can just pay some funny amount for millions of users data.

I think a better way is to deregulate, make the majority of the stuff you talk in private legal, ok, correct. This way you have nothing to hide and nothing to fear.

For violent criminals, I think it’s fair to see their search history so that they can be put to jail asap.

We just need to narrow the regulations and make the laws simple, easy and much much less.

It is fair only if you have a warrant. But whenever there is an optionality, you can be damn sure it will be used for mass surveillance.

I talk lots of funny shit that could be taken out of context. Even at work. I have a black friend who makes black jokes with me, and i join, then i make jokes about whites too. Wouldnt want that sort of stuff to be taken out of context for example.

Make those talk legal, ok and correct. When those shit is not illegal, not wrong, nobody would waste their time to take it out of context and harm you

Hiding under encryption won’t help much. Media can make you guilty even if you never go out of your basement

media making you guilty vs some law enforcement finding convenient evidence are different things.

Yeah it’s different. Just deregulate so good people are not living under fears of the government and law enforcement
